On July 10, 2025, Calcutta High Court division bench upheld ban against candidates involved in prior recruitment malpractices from applying for teaching positions in WBSSC current hiring process. The decision reinforces the court's stance against malpractice, ensuring only eligible candidates proceed in the selection process.
In a decisive move, Justice Sougata Bhattacharya of Calcutta High Court ruled on July 07, 2025, that candidates implicated in previous recruitment irregularities would not only be barred from the ongoing teacher selection process but also have their applications automatically canceled if submitted. The order mandates WBSSC to enforce this directive strictly, reinforcing a zero-tolerance policy toward malpractice.
The Calcutta High Court's division bench, led by Justices Soumen Sen and Smita Das De, rejected on July 10, 2025 the state government and WBSSC appeals against disqualifying candidates with prior recruitment violations from the teacher hiring process. The bench sharply questioned the authorities' insistence on defending candidates from the 2016 panel who had secured appointments through fraudulent means, emphasizing the need for integrity in public sector hiring.
During the July 10, 2025 hearing, Calcutta HC division bench posed a pointed question to the WBSSC "How can the Commission justify supporting candidates already declared "tainted" by the Supreme Court in WBSSC recruitment scam?" The query came as the WBSSC's legal team, led by Senior Advocate Kalyan Banerjee, argued that barring these candidates violated their fundamental rights.
The Calcutta High Court's ruling draws a clear distinction between 'tainted' and 'untainted' candidates in the ongoing West Bengal teacher recruitment process. 'Tainted' candidates specifically refer to those who allegedly secured teaching positions through corrupt practices or fraudulent means in previous recruitment drives, as identified by both the West Bengal School Service Commission and CBI. In contrast, 'untainted' candidates denote applicants with clean records and no allegations of misconduct in their appointment process. This classification forms the legal basis for the court's decision to bar certain individuals from fresh recruitment, ensuring only candidates with unblemished credentials are considered for teaching positions in state-run schools. The demarcation aims to restore transparency and public trust in the education department's hiring system while maintaining fairness toward genuinely qualified applicants.
The Calcutta High Court's latest decision builds upon the Supreme Court's landmark April 03 ruling that canceled the entire 2016 State Level Selection Test recruitment panel, invalidating 25,753 irregular appointments of secondary teachers and non-teaching staff. In response to this sweeping judicial order, the West Bengal government has initiated a fresh recruitment drive for 44,000 teaching positions, with a mandated deadline to complete the process by December 2025. The current court proceedings focus on ensuring this new hiring process maintains absolute integrity by permanently excluding candidates previously identified as having secured jobs through fraudulent means in the scrapped 2016 selection cycle. This judicial oversight aims to establish a corruption-free recruitment mechanism while addressing the urgent need to fill critical teaching vacancies across state-run schools.
Senior Advocate Bikash Ranjan Bhattacharya, representing teachers who lost their positions following the Supreme Court's cancellation of the 2016 appointments, expressed strong disapproval of the West Bengal government's stance. He criticized the administration's decision to challenge the single bench order and its apparent support for candidates identified as 'tainted' in the WBSSC recruitment scam. Bhattacharya emphasized the irony of the state government defending individuals whose appointments were annulled by the apex court, particularly when thousands of qualified teachers remain unemployed due to the fraudulent 2016 selection process. His remarks highlight the ongoing tension between judicial efforts to clean up the education recruitment system and the state's controversial position in this sensitive matter affecting thousands of teaching professionals.
